Twitter has been in the news recently for failing to act early to protect the word “tweet” as a trademark. After prolonged (but unsuccessful) efforts to register “tweet” with the USPTO, Twitter recently settled a lawsuit with the owner of what was the last remaining relevant pre-existing trademark registration application on file. According to news reports, the settlement transfers the pre-existing trademark to Twitter, finally making way for Twitter to complete registration of the “tweet” trademark.
