Only 53% of companies have a formal social media policy, and 42% say "No" to any social media use, according to a recent article on Mashable (with the help from Payscale).It's shocking that barely half of the companies have a social media policy to help guide employees on proper conduct.

Interesting post on the legal points of social media policy. I would suspect there are some real thorny questions in here and, as a small business person, I'd really prefer to stay as far as possible from trying to restrict social media activities among employees. I'd be concerned about precisely the kinds of legal troubles you're alluding to plus the futility of expending resources to try to control something as pervasive as social media. I may be alone in this position, but feel pretty strongly that it's better to gain buy-in from employees in the hopes that mention they make of the company in social media will tend to enhance my brand.
