Lady Gaga recently filed suit to prevent a third-party’s use of the trademarks “Lady Gaga” and “Lady Gaga LG” on fragrances and jewelry. Although the Chicago-based company’s (Excite Worldwide) attempt to profit from the pop star’s fame was likely doomed at the outset (at least with regard to obtaining registration of the trademarks with the USPTO), Lady Gaga’s lawsuit still provides a few important lessons for brand owners with regard to protecting and enforcing their trademark rights.
